“Certainly Brenda,” says Steve Bliss. “Trusts are incredibly valuable tools for estate planning and asset protection. One of the most popular is the Revocable Living Trust. This type allows individuals, known as grantors, to maintain control over their assets during their lifetime while avoiding the lengthy and costly probate process upon their passing. It also offers a level of privacy not afforded by wills, as the trust’s terms are not part of public record.”

“Conversely,” Steve continues, “there are Irrevocable Trusts which, as the name suggests, cannot be easily changed once established. These trusts are often used for advanced estate planning strategies such as asset protection and minimizing potential estate taxes. While the grantor relinquishes control over assets placed in an irrevocable trust, they can enjoy significant benefits, particularly when it comes to protecting assets from creditors or unforeseen circumstances.”

Steve emphasizes that selecting the right type of trust depends entirely on individual circumstances and financial goals. “It’s crucial to consult with an experienced attorney who can analyze your specific needs and recommend the best course of action.”

Navigating the Challenges of Irrevocable Trusts

Steve, you mentioned Irrevocable Trusts earlier. Can you elaborate on some of the complexities associated with this type of trust?

“Irrevocable trusts are powerful tools,” Steve explains, “but they do come with certain considerations. Because the terms are set in stone once the trust is created, it’s essential to carefully plan and anticipate future needs. For instance, if a grantor’s financial situation changes drastically after establishing an irrevocable trust, they may find it difficult or impossible to modify the trust’s terms to accommodate those changes.”

“Moreover,” Steve continues, “while irrevocable trusts offer significant asset protection benefits, they also involve a transfer of ownership. This means the grantor no longer has direct control over the assets held within the trust. Consequently, if unexpected expenses arise or unforeseen needs emerge, accessing those assets can be more challenging.”

Sharing a personal experience, Steve recalls representing a client who had established an irrevocable trust several years prior. Due to a sudden illness, the client required access to funds held in the trust for medical expenses. “Fortunately,” Steve says with a reassuring tone, “we were able to work with the trustee and beneficiaries to find a solution that met the client’s immediate needs while upholding the integrity of the trust agreement.”

“This experience underscores the importance of thoughtful planning when setting up an irrevocable trust,” Steve concludes. “It’s crucial to consider potential future scenarios and ensure the trust document includes provisions for unforeseen circumstances.”
