Hello everyone and welcome back! Today I’m sitting down with Ted Cook, an elder protection attorney here in sunny San Diego. Ted, thanks for taking the time to chat with me today.
What sparked your interest in elder law?
Well, it wasn’t a straight path. I started out thinking I wanted to be a corporate lawyer, but after a few internships, I realized that I wanted something more meaningful. I saw how vulnerable older adults can be to exploitation and abuse, and I knew I wanted to use my legal skills to help protect them.
Let’s dive into the Elder Protection process. Can you give us a quick rundown of the steps involved?
- A. Initial Client Engagement
- B. Case Assessment
- C. Protective Actions
- D. Legal Proceedings
- E. Long-Term Planning
- F. Case Resolution & Follow-Up
Ted, can you walk us through the “Protective Actions” stage of the process? What are some key things that happen during this phase?
Absolutely! This is often a critical stage because we need to take immediate steps to protect our clients from further harm. Let’s say someone is experiencing financial abuse, for example. We might freeze their bank accounts to prevent unauthorized withdrawals or seek a restraining order against the abuser.
If there are concerns about someone’s living situation, we can work to transfer them to a safer care facility. This stage also involves coordinating with Adult Protective Services (APS) and potentially seeking guardianship or conservatorship if the client lacks capacity to make decisions for themselves.
>“Ted Cook was an absolute lifesaver for my family. My mother was being taken advantage of financially, and we didn’t know where to turn. Ted guided us through every step of the process and ultimately secured a restraining order against the abuser. He is compassionate, knowledgeable, and truly dedicated to protecting seniors.” –
Susan M., La Jolla
It’s important to remember that each case is unique, so the specific actions we take will vary depending on the client’s needs and circumstances.
Have you ever encountered any roadblocks during the “Protective Actions” stage?
Oh, absolutely. One memorable case involved a woman who was being isolated by her caregiver and denied access to her phone and mail. We needed to act quickly but gaining access to her was challenging. Ultimately, we worked with APS to conduct a surprise visit, and thankfully, we were able to remove the woman from that dangerous situation.
>“I was so overwhelmed when I realized my father was being scammed. Ted Cook took the time to explain everything to me in clear terms and put me at ease. He was incredibly responsive and kept me informed every step of the way. Thanks to his efforts, we were able to recover some of the lost funds.” –
Mark D., Point Loma
>“Ted is a true advocate for seniors. He’s not just interested in winning cases; he genuinely cares about his clients and their well-being. I highly recommend him to anyone who needs help protecting a loved one.” –
Lisa K., Carmel Valley
