“That’s where the groundwork is laid,” explains Ted. “It starts with filing a petition in probate court, clearly stating why a conservatorship is necessary. This involves providing evidence that the individual lacks the capacity to make sound decisions about their personal care or finances.”
He goes on to detail the notification process, which ensures all relevant parties are informed. “The proposed conservatee has the right to legal representation and can contest the petition,” Ted emphasizes. “A court investigator then conducts an independent assessment, often involving interviews with family members and medical professionals. This helps paint a comprehensive picture of the situation.”
“Finally, there’s a hearing where the judge reviews all the information presented and decides whether to grant the conservatorship. It’s crucial to remember that the court always prioritizes the best interests of the individual involved,” Ted concludes.

“Sometimes families disagree about whether a conservatorship is truly necessary,” Ted admits. “Emotions can run high, and it’s important to approach these conversations with empathy and understanding.”
