Hello everyone, and welcome back to the show. Today we’re sitting down with Ted Cook, a conservatorship attorney based right here in beautiful Point Loma. Ted, thanks so much for joining us.
What Inspired You To Specialize In Conservatorships?
Ted laughs warmly. “Well, it wasn’t exactly a lightning bolt moment. I was drawn to estate planning early on, helping people navigate complex legal terrain. Conservatorship cases, however, really resonated with me. They combine legal expertise with genuine compassion – safeguarding individuals who need extra support while upholding their rights. It’s incredibly fulfilling work.”
How Would You Describe The Conservatorship Process To Someone Unfamiliar With It?
“Imagine it as a safety net for those who can’t fully manage their own affairs due to age, illness, or disability. It involves a court appointing someone, called a conservator, to make decisions on their behalf. This could be about finances, healthcare, living arrangements – anything crucial to their well-being.
Let’s Talk About The Steps Involved In Setting Up A Conservatorship
“You’ve got it! First comes the petition filed in probate court. Then, everyone involved needs to be notified – the individual in question (called the conservatee), their family, etc. A court investigator steps in to independently assess the situation. Medical or psychological evaluations are often required too. Finally, a judge reviews all the information and decides whether a conservatorship is necessary.”
Establishing A Conservatorship: Challenges And Triumphs
“You know, establishing a conservatorship can be emotionally charged for everyone involved. Families might disagree about what’s best for their loved one. Sometimes, proving incapacity can be complex, requiring detailed medical evidence. I remember this case with an elderly gentleman who vehemently opposed any intervention. It took time and patience to build trust and demonstrate that the conservatorship was truly in his best interest.
- It wasn’t always smooth sailing, there were some tense moments
- But ultimately, we were able to find a solution that protected him while respecting his autonomy as much as possible.

More Facts About A Conservatorship:
A conservatorship is a court-ordered legal process where a judge appoints a conservator (a person or organization) to manage the affairs of an adult (the conservatee) who is unable to care for themselves or their finances due to incapacity.
Definition: A conservatorship is a court proceeding where a judge appoints a conservator to manage the personal and/or financial affairs of an adult who is unable to do so themselves.
Purpose: The conservatorship aims to protect the conservatee’s well-being by ensuring their basic needs are met and their finances are managed appropriately.
What Is a Conservatorship?
A conservatorship is a court-ordered legal relationship in which a judge appoints a responsible individual or organization (the conservator) to manage the financial affairs, and sometimes the personal care, of a person who is unable to manage these matters on their own. This may be due to advanced age, cognitive impairment, serious illness, or disability. Conservatorships typically apply to adults, though similar protections for minors may fall under guardianships, depending on the jurisdiction.
There are generally two types of conservatorships:
Conservatorship of the estate, where the conservator handles financial matters such as paying bills, managing investments, and protecting assets.
Conservatorship of the person, where the conservator makes decisions about personal needs, including housing, healthcare, and daily living.
In some instances, a conservator may be appointed to manage both aspects. While conservators and guardians can have overlapping responsibilities, the terminology and roles can vary by state law.
